Terms of Service

Draft for owner and legal review. These terms have not been reviewed by counsel and are not in effect. Until final terms are published, each firm's use of Pencil is governed by its written agreement with us.
1. Who these terms cover
These terms govern use of Pencil (pencil.broker) by firms that have an account and by the people those firms invite. In these terms, "Pencil", "we" and "us" mean the operator of pencil.broker, and "you" means the firm and its users.
2. Accounts
Accounts are set up for each firm by our team. You are responsible for the people you invite, for keeping sign-in details safe, and for telling us promptly about any unauthorised use.
3. Acceptable use
- Use Pencil for commercial real estate research, origination and deal work.
- Do not use Pencil's data to decide anyone's eligibility for credit, employment, insurance or housing.
- Follow telemarketing, privacy and other contact laws when you reach out to owners, including do-not-call rules.
- Do not resell or republish Pencil's data in bulk, scrape the service, or try to get around its security or limits.
4. Data and sources
Pencil compiles public records and licensed data and cites its sources. Records can be incomplete, out of date or wrong, and estimates are estimates. Check the source records before you rely on a figure for a decision.
5. AI features
Pencil's AI drafts answers, memos and outreach from the records it cites. Review AI output before you rely on it or send it.
6. Your content
What you put into Pencil, such as deals, notes, files and chats, stays yours. You give us permission to host and process it only to run the service for you. Our Privacy Policy explains how we handle personal information.
7. Fees
Fees, if any, are set out in your firm's order form or written agreement.
8. Suspension and ending
We may suspend access that breaks these terms or puts the service or others at risk. You can stop using Pencil at any time; your written agreement sets out notice and what happens to your content.
9. Disclaimers and liability
